Terms of service

These Terms of Service ("Terms") govern your use of the Videlia application ("the App"), provided by {{COMPANY_NAME}} ("we", "us"), as installed on a Shopify store ("you", "your store"). By installing the App you agree to these Terms.

1. The service

Videlia generates on-model images and short videos from product photos you select, and lets you publish them to your product pages or download them for use elsewhere. Generation is performed by third-party AI providers, named in our privacy policy. Output quality and generation time depend on those providers and are not guaranteed.

2. Subscription and billing

The App is billed through Shopify's managed App Pricing. Charges appear on your Shopify invoice; we do not bill you directly.
Plans, prices and the monthly credit allowance for each are shown in the App, on the App Store listing and on our pricing page. We may change them with notice, via Shopify's standard process for pricing changes.
Downgrading or cancelling takes effect according to Shopify's subscription billing rules.

3. Credits

Generation is metered in credits. A try-on image costs 1 credit, a 5 second video costs 3 credits and a 10 second video costs 6 credits. Current prices are always shown in the App at the point where a credit is spent.

You hold two balances, and they are spent in this order:

Plan credits, your monthly allowance. Unspent plan credits are banked as rollover at the end of each billing cycle.
Rollover credits, banked from previous cycles and capped at two months of your plan's allowance. Anything above that cap is not carried forward.

If a generation fails for a reason on our side or a provider's, the credits are refunded to your balance automatically. Credits have no cash value and are not refundable or transferable between stores. There are no one-time credit purchases: Shopify's managed pricing does not permit an app to create such a charge.

4. Your content

You retain all rights to the product photos, model images, brand assets and other content you upload or select ("Your Content").
You grant us a limited licence to process Your Content solely to generate, store and deliver the media you request, including transmitting it to the AI providers named in our privacy policy.
You represent that you hold the rights to Your Content, and that it does not infringe any third party's rights or depict a real person without their consent.

5. AI-generated output

Generated media is produced by AI models and may not faithfully represent the source product. Colour, fit, drape, texture and fine detail can differ from the real item.
You are responsible for reviewing generated media before publishing it to your storefront or using it in marketing. Consumer-protection and advertising rules in your market may govern how AI-generated imagery of a product may be presented; meeting them is your responsibility.
The models shown in our gallery are AI-generated likenesses and do not depict real people.
We do not guarantee that output is free of visual artifacts, and we are not liable for how you use it.

6. Acceptable use

You agree not to use the App to:

Upload content that is illegal or infringing, or that depicts a real person without their consent
Attempt to circumvent plan entitlements, credit accounting or rate limits
Reverse-engineer, scrape or resell access to the App or to the AI providers behind it
Use the App in a way that breaches Shopify's Acceptable Use Policy or Terms of Service

7. Data and privacy

Our collection and use of data is governed by our privacy policy, incorporated into these Terms by reference.

8. Disclaimers and limitation of liability

The App is provided "as is", without warranties of any kind, express or implied.
To the maximum extent permitted by law, {{COMPANY_NAME}} is not liable for indirect, incidental or consequential damages arising from use of the App, including lost sales, lost profits or reliance on AI-generated output.

9. Service availability

The App depends on Shopify's APIs and on third-party AI providers. We do not guarantee uninterrupted availability, and generation may be delayed or temporarily unavailable when a provider is degraded. Where a generation fails, the credits are refunded as described in section 3.

10. Termination

You may stop using the App at any time by uninstalling it from your Shopify admin.
We may suspend or terminate access for breach of these Terms, non-payment or abuse of the service.
On uninstall, your data is retained briefly and then permanently deleted, as set out in our privacy policy.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the App after a change constitutes acceptance. Material changes will be communicated to the store contact email on file.

12. Governing law

These Terms are governed by the laws of {{JURISDICTION}}, without regard to conflict of law principles.
